Terms of Use

Last updated: July 5, 2026

Welcome to When I Die ("we", "us", or "the Service"). By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the Service.

1. Nature of the Service

When I Die is an end-of-life planning tool that helps users document personal wishes regarding medical care, body disposition, belongings, finances, and legacy items. The Service provides general informational guidance about legal frameworks in various jurisdictions. It does not provide legal, medical, financial, or professional advice.

2. Not Legal or Medical Advice

Content on this website, including jurisdiction-specific legal summaries, is for educational and planning purposes only. Laws vary by country, state, and locality and change over time. You must consult qualified attorneys, physicians, and financial advisors before relying on any information from this Service. We make no warranty that your documented wishes will be legally binding or enforceable.

3. User Accounts and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to update your death wishes as your circumstances change. You must not use the Service for unlawful purposes, to impersonate others, or to publish content that is defamatory, harassing, or violates third-party rights.

4. Public Registry

If you choose to publish your death wish to the Public Registry, selected profile information (such as name, photo, country of residence, and age) and your wish details become visible to anyone visiting the website. You may unpublish at any time. We are not responsible for how third parties use publicly displayed information.

5. Privacy and Data

We store account and wish data to operate the Service. Uploaded photos and personal content remain your responsibility. We do not sell personal data. However, no online service can guarantee absolute security. You should avoid storing highly sensitive credentials or information not necessary for end-of-life planning.

6. Intellectual Property

The When I Die name, design, software, and original content are owned by us or our licensors. You retain ownership of the personal content you create. By publishing to the Public Registry, you grant us a non-exclusive license to display that content on the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

8. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including disputes among family members regarding documented wishes, or reliance on legal summaries provided herein.

9. Modifications

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be reflected in the "Last updated" date above.

10. Governing Law

These Terms are governed by applicable laws of the jurisdiction in which the Service operator is established, without regard to conflict-of-law principles. Disputes shall be resolved in the competent courts of that jurisdiction unless otherwise required by mandatory local law.
